No, not all years of black are the same. However, the ColorRight site indicates that the paint code is the same for 2012 and 2013 metalic spark black.
Definitely the lowers are different colors. Yours is a flat black and the lower on the 2013 fairing in the ad is glossy.
Be very, VERY careful about buying fairings on Ebay. If you do a Google search, you'll find that point made over and over. The description of the item does not make me very confident it will be in like new condition. Also, if you mouse on the pics to magnify them, it sure looks like there are marks on the fairing. THere are what appears to be some small but obvious digital touchups. Look near the angle where the side meets the lower. Also, other places.
If it was my bike, I'd buy a new fairing from a reliable seller. The fairing you have now doesn't look bad except for the lower.
Is it just the lower that is damaged? If so, I'd try sanding/buffing that out smooth and spray paint it flat black. You'll probably want to do that to both after a few years anyway.
BTW, I can't give a 100% recommendation on DIY matches with ColorRight paint. If you know exactly how to apply it, you can probably match the OEM color. I found the frame color difficult to do a perfect match using colorRight paint. It's very expensive and not always easy to use.
