Cop questions?
05/06/12 8:02 PM

Ok I live in a town of about 20 thousand people. If a cop tries to pull me over but doesn't get my plate # and he doesn't catch me can he stop me say the next day? There are other green bikes in town, could he legally give me a ticket or would he be bound by the time of the incident.

In MI, the only 2 basic things a cop can stop you for that HE/SHE didn't witness is running Rail Road signal or Shoolbus signal. Anything else he has to witness, AND stop/verify the driver/rider. This goes for basic violations, speeding, redlight, etc.

worse violations; fleeing and eluding, dui, reckless driving are diff. hard to say whether he could make it stick the next day, if it was just a basic speed violation. PLUS he still wouldn't be able to prove who the rider was. and if he didn't see your plate, and you didn't have the cops knocking on your door that night/early next day. your likely fine.

take this with a grain of salt. Ive not worked with leo in a long time, and Im coming fomr a diff state, where the laws may be diff. and Im not a lawyer. If you truely have a legal concern, call a lawyer.

oh, and to be sure; stay off the bike for a few days/week. it'll blow over. most likely. and if you can, wear diff gear/color helmet the next few times you ride. assuming you had some on anyway.

dont answer this here. but, curious tho. was he actually chasing the rider? or was it like they were clocking speeders on the freeway from an onramp, or hiding spot, or turnaround, and this person on the bike went by really fast and just kept going untill out of sight.

Ive ridden past a sherrif trying to clock vehicles, I was following (couple hundred yards) behind a few cars all going 85-90 plus in a 70. he might not have tried to radar/laser the 1st group, but I saw him point the gun at me 2x when I went by. turned his headlights on (it was dusk), but never did come out. even if I lived in a small town, for that type of incident, I wouldn't worry (the next day).

BEST advice I can give, if you zip past a cop; slow down and let him come. make it obvious your not running, steady speed (at the limit, or slightly below). chances are, as long as your not doing something too stupid, he'll be much nicer to deal with. and may even make it a warning.

and if you ran because your not properly liscenced, insured, plated, etc. get that stuff handled.

Most police now have video cameras in their cars. If the camera gets your plate, even if they have to enhance it the next day to read it, you can be ticketed on that evidence.

What are you going to do with the info you get here? This is probably not the best place to get legal advice, sure, it's free, but you get what you pay for.

may even make it a warning.

cops are not going to give a 17 year old a break, Especially not if he is riding a ZX-14. I got NO breaks when I was 17. Got a couple tickets on a probationary license, though. Had to do traffic school.

I don't ever recommend running. That's a felony. Only time I would keep going is if it was not obvious that they were after me which means they are way the hell far away from me or going the opposite direction.

Also, cops can do pretty much anything, legal or otherwise, with far less risk to being caught than you or I. If they want to chase someone three days later, all they need to do is claim they witnessed that person driving recklessly. A person living in a small community is likely to be seen repeatedly if they are always speeding. Moreover, the cops will easily find out who that person is, even more so if they are on /in an unusual vehicle.

Speaking as a guy who grew up in a town of 15,000, I wouldn't screw with the cops. it's just way too easy to target a person in a small community. I would go out somewhere far into the sticks to do my fast riding --in fact, that's really the only place in a large city like I now live in. ..or better the track. I rarely do more than 70 in town any more. pretty unfortunate. lol

well, you gotta start somewhere.

I think that in most cases, if you think you know, you're prolly right on track. I wouldn't pay an attorney to tell me what traffic laws are. There's a whole internet of info. If a person flees, there is no statute of limitation on that because that was a felony. If the cops knew who the person was, they would be at that persons door ASAP. I'm sure there is no threat of arrest if no cops show within 24 hours. No guarantee that they are not watching to find a more solid case though.

In Texas they use video cams at stop lights and toll booths (Not the DPS), but you can be ticketed days after a violation - when they can't ID the rider, the ticket is given to the registered owner of the vehicle...(by snail mail) I would assume it would be the same for a speeding violation or others...

Bingo, bigwilliezx.

With the photo radar, its almost all private companies across the nation. The letter goes to the registered owner, who is legally responsible for the vehicle.

If you choose not to pay it, it becomes a (larger) police citation and goes on your record.

There really isn't any defense. Your vehicle. In the picture. Going X mph over the limit printed on the picture.

And even without photo radar, if the cop just follows you and you run away. All they need is a printount from the video camera (they do zoom, you know) and voila, a citation is issued. Courts accept police speed estimates if they say "we pursued at [speed limit + 10] and could not keep up with the motorcycle" as proof the motorcyclist was more than 10 over, for example.

Trc, if you need a flipper plate, you're in the "I'm going too get busted within a year" club. If you are really going fast, the plate might just eat up the other half of your points that would have been left and you're done. I would NEVER drive with a suspended or revoked license in a smallass town like you live in. you'd never get away with that during the day.

I was 43 and I got to the point that I just thought the chances of actually having a ticket were easy enough to beat. It didn't really matter that I was getting very bold and quite sloppy about my speeding habits. When they got me it was totally by surprise. Never would have guessed there was even a reason to be careful. I can't imagine how much less careful I would have been at 17.

You start having trouble with the law and they will target you in a small town like that. Their job is to make the tax payers feel like they are safe. Real criminals try to keep a low profile. Speeders are easy pickins and the bluehairs will read about you busted for doing 140 mph and feel like they have been protected from you and the likes of all those and drug dealers and illegal weapons trafficers.

Yeah man, you don't want to hear it, but being in a small town like that it's just a matter of time. Every time you burn past a cop, every time you get away, you become a little bigger blip on their radar. At some point you will be a big enough blip that they will decide to get you and they will, one way or another. They're cops, but they're not retarded, and they have the resources to be able to deal with you if you become a big enough problem. For every legal technicality you can think of, the cops have 2 ways around it; They've been doing this game since before you were born.

Really.

If it were me, and I NEEDED to ride like a jackass, I would at least do it in other towns. Hell, find a bike night in a big city, where you can hang out with lots of other jackasses. That way you can have your fun, but keep it down and stay out of trouble where you live.

If you're lucky (from the sound of it, you'll need a bit!), years from now you'll be like the rest of us 'old farts', looking back, thinking "how the hell did I survive my own stupidity?!" and trying to pass that wisdom on the next generation of foolish kids that already know everything.

Ride safe bro.

May your wisdom always be greater than your confidence.

I've been on here longer then you so don't ask me quesions. I don't have a suspended license. I have the plate if a cop tries to get me in the country. I don't speed in town. I stay out of trouble and I obviously know how to ride or I wouldn't have a 14R.

Yeah TRC.. we were all 17 with giant balls at one time. You'd do yourself a favor by not replying like you just did.

Go do a few track days and get it out of your system. Save the extreme fuckery for when you're 20 miles from nowhere.

TRC, I don't know you. I don't personally know anyone on this site. But what it seems like is that you are getting defensive over this topic when anyone says something you don't like. For all I know, you could be a semi-pro rider, blah blah blah. But from the posts I've seen from you, it seems you are headed for some real trouble. I am not going to harp on you, I just want to say, be smart and be SAFE.

A bunch of tough guys on the internet.... As far as having a ZX14R and being 17, congrats and I hope that I dont read about you getting killed on it. Reguarding the rights of Police, it does vary stgate to state... BUT, it sounds like its a matter of time before you get nailed. Trust me on this, don't try and lose a cop... You can outrun his car but not his radio. Here is another brain surgeon... This dipshit got nailed doing 170 and told the cops he could have gone 190.
